Flourish'n'Thrive Naturopathy is operated by Vicki Jones, a naturopath practising in Australia. We are committed to protecting your privacy and handling your personal and health information with care, respect, and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Information we collect

Information you provide directly

  • Name, date of birth, and contact details (email, phone, address)
  • Information submitted via contact or enquiry forms on our website
  • Information provided when booking through Cliniko
  • Health and medical history provided through Cliniko intake forms
  • Communications you send to us by email or other means

We do not use Google Analytics, Facebook Pixel, or any third-party tracking or advertising tools on our website.

3. Health information

As a naturopathic practice, we collect and handle sensitive health information as a necessary part of providing you with clinical care. This includes medical history, current symptoms, medications, pathology results, lifestyle information, and treatment notes.

Health information is sensitive information under the Privacy Act. We will only collect health information that is reasonably necessary to provide you with naturopathic services, and we will always seek your consent before doing so.

Your health information is stored securely within Cliniko and is never sold or shared with third parties for marketing purposes.

4. How we use your information

We use your personal and health information to:

  • Provide naturopathic consultations and clinical care
  • Manage appointments, bookings, and client records
  • Communicate with you about your care, appointments, or enquiries
  • Process payments for services rendered
  • Comply with legal and professional obligations
  • Improve the quality of our services

We will not use your information for any purpose unrelated to your care or our legitimate business operations without your consent.

5. Disclosure of your information

We will not disclose your personal or health information to third parties except in the following circumstances:

  • With your consent — for example, when referring you to or corresponding with your GP or a specialist
  • As required by law — including mandatory reporting obligations or in response to a lawful request from a regulatory authority
  • To our service providers — specifically Cliniko, which processes and stores client data on our behalf under their own privacy and security frameworks
  • To protect health or safety — where there is a serious and imminent threat to your life or safety, or that of another person

We do not sell, rent, or trade your personal information to any third party.

6. Patient Notes AI

We use Patient Notes AI, an artificial intelligence tool, to assist with generating clinical notes following consultations. This tool processes information discussed during your appointment to produce a structured summary that forms part of your clinical record.

By engaging in a consultation with us, you consent to your consultation content being processed through Patient Notes AI for the purpose of clinical note generation. If you do not wish your consultation to be processed in this way, please let us know before your appointment begins and we will make alternative arrangements.

How your information is used

  • Consultation content is processed solely for the purpose of generating clinical notes
  • Generated notes are reviewed by your practitioner before being added to your health record
  • Your information is not used to train AI models or for any purpose beyond clinical note generation

Patient Notes AI operates under its own privacy and security framework. We have satisfied ourselves that the platform handles health information in a manner consistent with our obligations under the Privacy Act 1988 (Cth). If you have questions about how Patient Notes AI handles data, please contact us and we will provide further information.

You have the right to opt out of AI-assisted note generation at any time. Please advise us before your consultation begins.

7. Cliniko

We use Cliniko to manage appointments, health intake forms, clinical notes, and payments. Cliniko is an Australian-based practice management system that complies with Australian privacy law and healthcare data standards.

When you book an appointment or complete an intake form through Cliniko, your information is stored within their secure platform. Cliniko's Privacy Policy applies to data held within their system and can be found at cliniko.com/policies/privacy.

8. Clients under 18

We occasionally provide services to clients under the age of 18. Where a client is under 18, a parent or legal guardian must provide consent for treatment and will be responsible for providing health and contact information on the client's behalf.

Health information collected about a minor is handled with the same care and confidentiality as all client information. Our website is not directed at children, and we do not knowingly collect personal information from anyone under 18 outside of a clinical context with appropriate parental consent.

9. Data security

We take reasonable steps to protect your personal and health information from misuse, interference, loss, and unauthorised access, modification, or disclosure. Measures include:

  • Use of Cliniko, which employs industry-standard encryption and security practices for health data
  • Password-protected access to client records
  • Secure email communication for clinical correspondence

While we take all reasonable precautions, no method of electronic transmission or storage is completely secure. If you have concerns about the security of your information, please contact us.

10. Your rights

Under the Australian Privacy Principles, you have the right to:

  • Access the personal information we hold about you
  • Correct information that is inaccurate, out of date, incomplete, or misleading
  • Request deletion of your information, subject to our legal and professional obligations to retain health records
  • Complain to us about a breach of your privacy, and to escalate to the Office of the Australian Information Commissioner (OAIC) if unresolved

11. Data retention

We retain health records in accordance with applicable Australian law. For adult clients, health records are generally retained for a minimum of 7 years from the date of last treatment. For clients who were minors at the time of treatment, records are retained until the person turns 25, or for 7 years from the date of last treatment, whichever is longer.

When records are no longer required, they are destroyed securely.

1. Introduction

These Terms and Conditions govern your use of the services provided by Flourish'n'Thrive Naturopathy, operated by Vicki Jones ("we," "us," "our"). By booking an appointment, enrolling in a programme, or using our services, you agree to be bound by these terms.

2. Services

Flourish'n'Thrive Naturopathy provides naturopathic consultations, personalised nutrition programmes (including the Menopause Metabolic Reset), herbal and nutritional medicine, and hormone health support.

Naturopathy is a complementary healthcare discipline. Our services are intended to complement, not replace, conventional medical care. We do not diagnose, treat, or cure medical conditions as defined under Australian law. Naturopathy is not currently regulated by AHPRA.

We reserve the right to decline or discontinue services to any client where we reasonably determine it is not in their best interest or is outside our clinical scope.

3. Booking and appointments

Appointments are booked through our Cliniko online booking system. By completing a booking, you confirm that the information you have provided is accurate and complete.

Cancellations and rescheduling

  • We require a minimum of 24 hours notice to cancel or reschedule an appointment.
  • Cancellations made with less than 24 hours notice, or failure to attend without notice, may incur a cancellation fee of up to the full consultation fee.
  • We reserve the right to charge for missed appointments at our discretion.

Our right to reschedule

In the event we need to reschedule your appointment, we will provide as much notice as possible and offer an alternative appointment time. No fee will be charged to you in such circumstances.

4. Payment terms

General

All fees are quoted in Australian dollars and are inclusive of GST where applicable. Payment is due at the time of service unless a payment plan has been agreed in writing prior to commencement.

Programme deposit

A $200 deposit is required at the time of booking to secure your place in the Menopause Metabolic Reset programme. This deposit is deducted from your total programme fee.

Blood test fee

The blood test fee of $195 is payable directly to the referring laboratory and is separate from the programme fee. In some cases, your GP may arrange the required blood panel at no cost to you. We will guide you through this process before your first appointment.

Payment plans

Fortnightly payment plan options are available for both the 7-Week and 12-Week Reset programmes. Payment plans attract a 5% interest charge on the total programme fee. Instalments are processed fortnightly via Stripe. Full details are set out in the Programme Guide.

By agreeing to a payment plan, you authorise us to process instalments on the agreed schedule. It is your responsibility to ensure sufficient funds are available. Failed payments may result in suspension of programme access until the outstanding amount is resolved.

Non-refundable fees: The $200 programme deposit, the blood test fee ($195 paid to the laboratory), and the first payment instalment (or full payment on commencement) are non-refundable once paid. Please refer to the Refunds and Cancellations section below for full details.

5. Refunds and cancellations

Non-refundable fees

The following are non-refundable under all circumstances:

  • The $200 programme deposit, as this secures your place and initiates programme preparation
  • The blood test fee paid to the referring laboratory, as this is a third-party cost incurred on your behalf
  • The first payment instalment (or the payment made on commencement if paying in full), as this covers the initial consultation, personalised plan generation, and programme materials

Withdrawal after commencement

If you choose to withdraw from the programme after commencement, you will not be entitled to a refund of any fees already paid. If you are on a payment plan and withdraw mid-programme, any remaining scheduled instalments will be cancelled from the date of written notification. You will not be charged for future instalments, but no refund will be issued for amounts already paid.

Exceptional circumstances

We understand that unexpected circumstances arise. If you are unable to continue the programme due to a serious medical condition, bereavement, or other significant hardship, please contact us to discuss your situation. We will consider requests for partial credit or transfer of programme value on a case-by-case basis, at our discretion.

Programme delivery issues

If we are unable to deliver a material part of the programme due to circumstances on our end, we will work with you to reschedule, substitute, or credit the affected services. Refunds in these circumstances will be assessed on a case-by-case basis and in accordance with your rights under the Australian Consumer Law.

6. Health and medical disclaimer

By engaging our services, you confirm that:

  • You have disclosed all relevant health conditions, medications, and supplements to your practitioner
  • You understand that naturopathic advice does not constitute a medical diagnosis or replace advice from a registered medical practitioner
  • You will continue to consult your GP or specialist for any ongoing medical conditions
  • You will notify us of any changes to your health status, medications, or circumstances during the programme

We are not liable for any adverse outcomes arising from your failure to disclose relevant health information, or from your decision to discontinue prescribed medications without medical supervision.

Results vary between individuals. We do not guarantee specific outcomes from our programmes or consultations.

7. Client conduct

We are committed to providing a respectful, professional environment for all clients. We ask that clients:

  • Treat our practitioners and staff with courtesy and respect
  • Provide honest and accurate health information
  • Attend appointments on time or provide adequate notice of cancellation
  • Engage with the programme in good faith and as directed

We reserve the right to terminate a client relationship if conduct is abusive, threatening, or otherwise inappropriate. In such cases, no refund of fees paid will be provided.

8. Intellectual property

All content provided as part of our programmes, including educational materials, recipes, guides, videos, and resources, is the intellectual property of Flourish'n'Thrive Naturopathy. This content is provided for your personal use only and may not be shared, reproduced, distributed, or sold without our written permission.

Your personalised Metabolic Balance plan is generated through the Metabolic Balance system and is subject to Metabolic Balance's intellectual property terms in addition to our own.

9. Limitation of liability

To the extent permitted by law, Flourish'n'Thrive Naturopathy's liability for any claim arising from our services is limited to the total fees paid by you for the service in question.

We are not liable for any indirect, consequential, or special losses arising from your use of our services, including but not limited to loss of income, loss of opportunity, or worsening of a health condition.

Nothing in these terms limits your rights under the Australian Consumer Law, including any applicable consumer guarantees.
